WCO seeks to ensure effective local and state administration of authorized programs, safeguard federal fund expenditure, and enforce compliance with applicable federal regulations and state disseminated policy through efficient monitoring and resolution methods.
Authorizing Legislation
WCO is a federally mandated unit under the Workforce Investment Act (WIA sections 667.400 and 667.410). These sections require the Governor to develop a state monitoring system that continuously monitors federal grant-supported activities in accordance with applicable WIA requirements, Federal Uniform Administrative Requirements, and Federal Cost Principles for all entities receiving WIA title I funds. The Workforce Compliance and Oversight Unit fulfills this requirement through annual on-site employment and training reviews of Local Boards, One-stop operators, One-stop partners, and associated subrecipients.
Duties and Responsibilities
WCO monitors entities receiving federal funds to: determine whether expenditures were incurred within prescribed cost principles, ensure compliance with financial uniform administrative requirements, enforce sub-award agreements, assess operational efficiency relative to federal, state, and local benchmarks, and recommend corrective action when necessary and appropriate. WCO's specific responsibilities include:
· Conducting annual on-site financial reviews of Local Area compliance with United States Department of Labor Uniform Administrative Requirements;
· Verifying expenditure conformance to applicable cost principles;
· Ensuring that established policies relating to one-stop centers, eligibility determination, individual employment plan development, training provider selection, and youth activities provision conform to WIA requirements and meet stated local objectives;
· Promoting adherence to nondiscrimination and equal opportunity requirements;
· Recommending corrective action to address program deficiencies;
· Suggesting sanctions as necessary and appropriate for regulatory noncompliance and failure to take corrective action.
